Acceptance of Terms

By accessing and using HourForce 247's website and temporary staffing services, you accept and agree to be bound by the terms and provisions of this agreement. These terms apply to all job seekers, employees, employers, and other users of our platform. If you do not agree to these terms, please do not use our services.

Services Description

HourForce 247 (DBA for STACEY HOSKINS BEELER, L.L.C.) provides temporary staffing solutions connecting qualified workers with employers seeking short-term and flexible workforce solutions. Our services include:

  • Job matching and placement services
  • Background checks and employment verification
  • Skills assessment and training coordination
  • Payroll processing for temporary employees
  • Workforce management solutions for employers
  • On-demand staffing for various industries

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice when possible.

Employee Responsibilities

As a job seeker or temporary employee, you agree to:

  • Provide accurate, truthful, and complete information on applications
  • Maintain current contact information and availability status
  • Arrive punctually and prepared for assigned shifts
  • Follow all workplace policies and safety requirements
  • Complete required background checks and drug screenings
  • Report workplace injuries or incidents immediately
  • Maintain professional conduct at all work assignments
  • Not engage in direct employment negotiations with clients during assignments
  • Return all company property upon assignment completion

Employer Responsibilities

As an employer using our staffing services, you agree to:

  • Provide accurate job descriptions and workplace requirements
  • Maintain a safe, lawful, and harassment-free work environment
  • Comply with all federal, state, and local employment laws
  • Verify and approve timesheets in a timely manner
  • Pay invoices according to agreed payment terms
  • Provide necessary training and equipment for temporary workers
  • Report performance issues or incidents promptly
  • Not directly hire our employees during the contract period without consent
  • Maintain appropriate workers' compensation coverage

Payment Terms

For Employees:

Temporary employees are paid according to the agreed hourly rate for actual hours worked. Payment is processed weekly or bi-weekly via direct deposit or pay card. All required taxes and withholdings will be deducted. Overtime rates apply in accordance with federal and state laws.

For Employers:

Employers are invoiced weekly for staffing services provided. Standard payment terms are net 15 days from invoice date. Late payments may incur a 1.5% monthly service charge. A credit application and approval may be required before service commencement.

Background Checks and Drug Testing

Employment may be contingent upon successful completion of background checks and/or drug testing as required by specific job positions or employer requirements. By using our services, you consent to these screenings when applicable. Results are handled in compliance with FCRA and other applicable laws.

Non-Solicitation and Conversion

Employers agree not to directly hire or solicit temporary employees placed by HourForce 247 during their assignment and for 90 days following the last day worked, without written consent and payment of applicable conversion fees. Standard conversion fee is equivalent to 480 hours at the employee's current bill rate.

Limitation of Liability

HourForce 247's liability for any claim shall not exceed the fees paid for the specific services giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages. We do not guarantee job placement or continuous employment. Employment decisions are at the discretion of employers and work availability.

Indemnification

Users agree to indemnify and hold harmless HourForce 247 (DBA for STACEY HOSKINS BEELER, L.L.C.) and their officers, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these terms, or violation of any rights of another party.

Termination

We reserve the right to terminate or suspend access to our services immediately, without prior notice, for any violation of these terms, fraudulent activity, or other conduct we deem inappropriate. Employers may terminate temporary assignments with reasonable notice. Employees may resign from assignments with 48 hours notice when possible.

Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good faith negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Kentucky.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought in the courts of Kentucky.

Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after modifications constitutes acceptance of the updated terms. We recommend reviewing these terms periodically.
